Underwater recreational fishing
Underwater diving is allowed by free divers, without the use of mechanical diving assist devices, which are dipped with apnea and with the use of a hand harpoon or a device that launches a harpoon or dart (speargun), as long as the firing force is due to device by the diver, using exclusively his muscular strength.
Underwater recreational spearfishing is prohibited:
- From sunset to sunrise.
- The months of April and May of each year
- From minors who have not completed the 16th year of their age.
- At a distance of less than two hundred (200) meters from:
The places where swimmers swim.
Harbor works, maritime markings, boats or other fishing vessels and moored vessels over twenty (20) meters long. They do not include the vessel used by the amateur fisherman for underwater fishing. - In marine transit zones, within ports and fishing shelters, as well as at port entrances and exits or berths.
- Using underwater light.
Underwater fishing with a harpoon or spearfishing by minors who have reached the age of 16 is allowed, as long as they are supervised by an adult diver accompanying them. If the escort is not one of the persons exercising parental care of the minor, the written consent of the person or persons is required.
It is forbidden for amateur underwater fishermen:
- Remove catches from other fishermen 's gear.
- To carry armed spearguns out of the sea.
- Use any form of diving air supply device from a boat or portable stand-alone diving device. Amateur fishing gear is prohibited from carrying such devices.
Amateur fishermen during all underwater fishing at sea, are required to carry a floating yellow buoy, which will carry a yellow flag with a diagonal red line, on which will be written the digits Y.D. (Underwater Activity). The buoy must be visible with calm sea and normal lighting conditions and atmospheric clarity, from a distance of at least 300 meters.
If the underwater fisherman is accompanied by a vessel, the flag of paragraph 5 must be affixed in a conspicuous place on the vessel. The fisherman during the underwater fishing must move within a radius of 50 meters from the buoy or the vessel.
It is prohibited to approach a boat at a distance of less than 150 meters from a buoy or from a vessel accompanying a fisherman engaged in underwater fishing.
